These Terms of Service ("Terms") are a binding agreement between you ("you", "your", "User") and Swift Tax ("Swift Tax", "we", "us", "our"), governing your access to and use of the Swift Tax website, application, and related services (the "Service"). By creating an account, accessing, or using the Service, you accept these Terms in full. If you do not agree, do not use the Service.
Swift Tax is a software tool that helps businesses prepare, manage, and submit invoices and related tax data toward Pakistan's Federal Board of Revenue (FBR) Digital Invoicing System. Swift Tax is an independent third-party tool. It is not affiliated with, endorsed by, or operated on behalf of FBR or any government body. Any reference to FBR is solely to describe compatibility.
When you use the Service to validate or post invoices to FBR, you do so using a security token that you obtain from your own IRIS profile and that is bound to your seller NTN/CNIC. You authorize Swift Tax to store that token (in encrypted form) and to present it to FBR's Digital Invoicing gateway on your instruction. Transmission is through the gateway operated by Pakistan Revenue Automation Limited (PRAL), which FBR has designated as a licensed integrator for digital invoicing.
See our Refund & Cancellation Policy for further detail.
You retain ownership of the invoices, buyer records, item records, and other business data you submit to the Service ("Your Content"). You grant Swift Tax a worldwide, royalty-free license to host, process, transmit, and display Your Content solely to operate and provide the Service, including transmitting invoice data to FBR on your instruction.
You represent and warrant that Your Content is accurate, that you have the right to submit it, and that it does not violate any law or third-party right. You are solely responsible for Your Content and for the tax and legal consequences of submitting it.
You agree not to:
Violation of this section is grounds for immediate suspension or termination without refund.
Swift Tax is a software tool only. It is not a tax advisor, accountant, lawyer, or FBR representative, and nothing in the Service constitutes tax, legal, financial, or professional advice.
The Service integrates with third parties, including FBR's systems (via PRAL's Digital Invoicing gateway) and Google (for sign-in). We do not control and are not responsible for the availability, accuracy, security, or acts or omissions of these third parties. Any downtime, rejection, delay, or error originating from a third-party system is outside our control and outside our liability.
The service is provided "as is" and "as available", without warranty of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the service will be uninterrupted, timely, secure, or error-free. We disclaim all warranties to the fullest extent permitted by applicable law.
To the fullest extent permitted by applicable law, Swift Tax and its team, contributors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business, goodwill, or tax penalties, arising out of or relating to your use of, or inability to use, the Service, even if advised of the possibility of such damages.
In no event will our aggregate liability arising out of or relating to these Terms or the Service exceed the total fees you paid to us in the three (3) months immediately preceding the event giving rise to the claim, or PKR 5,000 if you are on a free plan.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you; in that case our liability is limited to the greatest extent permitted by law.
You agree to defend, indemnify, and hold harmless Swift Tax and its team, contributors, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) Your Content and the accuracy of your tax filings; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party right.
We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for suspected violation of these Terms, non-payment, or risk to the Service or other users. Upon termination, your right to use the Service ceases immediately; sections of these Terms that by their nature should survive termination (including Sections 2, 7, 9, 10, 11, and 13) will survive.
We may modify these Terms at any time by posting the updated Terms with a new "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, your only remedy is to stop using the Service.
We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, internet or power outages, FBR system failures, government action, labor disputes, or other events outside our control.
These Terms, together with our Privacy Policy, Refund & Cancellation Policy, and Cookie Policy, constitute the entire agreement between you and Swift Tax regarding the Service. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce any right or provision is not a waiver of that right. You may not assign these Terms without our written consent; we may assign these Terms freely.
Questions about these Terms can be sent to [email protected].
